TERMS & CONDITIONS, LIMITATIONS OF RESPONSIBILITY AND IMPORTANT DISCLOSURES
CONSENT TO TERMS & CONDITIONS:
Access to and use of the services of LINCONNECTION USA/Czech Tours & Travel - Tour Operator (LU/CT&T), and our website are subject to acceptance of these Terms & Conditions. Your use of the Site constitutes your agreement to all such terms, conditions, policies, and notices. By accessing, using, or obtaining any content, products, or services through our office or our websites, Customer agrees to be bound by these Terms & Conditions. If you do not accept all these Terms & Conditions, please do not use our services or websites.
LINCONNECTION USA/Czech Tours & Travel - Tour Operator, is acting as an agent for the land portion of the tour only. Participants are encouraged to purchase airline tickets no sooner than 90 days before the tour begins to avoid airline cancellation penalties if a tour is canceled or otherwise modified. Airline arrangements are available upon request. If requested - the airline ticket arrangement and issuance of tickets is by any means a direct transaction between the customer and airlines.
DEPOSIT AND FINAL PAYMENT*:
Acceptance for any tour will be upon receipt of the completed registration form and required tour deposit. A deposit check must be made and received by us by the date specified in the tour description/brochure (usually 4 months before the tour departure). The final past-due payment must be received by the date on your invoice (usually 90 days before the tour departure).

CANCELLATION & REFUND POLICY:
The following schedule of cancellation charges (unless they are set for specific private tours or individual travel arrangements) will be levied if any cancellation is received in writing by mail or e-mail before departure within 89-60 days: 25% of cost; 59-45 days: 50% of cost; 44-30 days: 75% of cost; 29 days or no shows: 100% of the cost. Full refund less $100 admin. fee per person for any cancellation received in writing within 90 days before departure (The customer acknowledges that any applicable third party supplier’s cancellation penalties shall apply. Supplier(s) may change their cancellation policies at any time). No refund of the deposit/payment will be made due to the non-cancelation notice. Any unused tour parts such as scheduled accommodation arrangements for hotel locations, services, or meals will not be returned. We reserve the right to cancel the tour anytime or due to lack of subscription, in which case a full refund will be made. LU/CT&T is not responsible for any travel arrangements affected due to cancellations, whether by the customer or by LU/CT&T for any reason, including without limitation, of the United States Department of State, World Health Organization, and any restrictions issued by the countries visited or other Warnings or Advisories of any kind. If the Customer cancels while a tour is in progress, there is no refund for the unused portion. Cancellation fees are strictly enforced. We strongly recommend for your protection that you purchase trip cancellation insurance.
TRAVEL INSURANCE IS RECOMMENDED:
TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF THE CUSTOMER’S TOUR. Travel Protection Policies offered by most major travel insurance providers include benefits such as trip cancellation, trip interruption, emergency medical and emergency evacuation/repatriation, trip delay, baggage delay, and more. For your convenience, we offer travel protection through Travelex Insurance Services. If you choose, you may purchase travel insurance from our website: www.czechtours.cz/travel-insurance. A paper form of travel insurance brochure by Travelex is available upon request. However, no representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance.

HEALTH MATTERS:
Health matters should be addressed to your physician. Customers traveling to areas where vaccination(s) are required are responsible for checking medical requirements for wherever customers may venture. Required or advised inoculations the customer decides to obtain upon the advice of the customer’s physician may need to be administered in a series of doses months ahead of the customer’s planned departure, and such time element should be taken into account by the customer BEFORE making deposits and/or non-refundable final payments. The website of the USA Center for Disease Control www.cdc.gov/travel provides additional information and relevant recommendations.
MEDICAL HEALTH INSURANCE is obligatory in the Czech Republic and all EU Schengen countries for all its citizens and all foreigners staying on the EU territory. The travel medical insurance must confirm the following requirements:
- coverage of costs incurred as a result of injury or sudden illness and medical repatriation to the
1) country whose travel document you hold or where you hold a residence permit;
2) coverage of up to the amount of at least 30,000 EUR (approximately. $45,000);
3) cover the entire period of your stay.
ITEMS NOT INCLUDED IN TOUR:
THE FOLLOWING ARE AMONG ITEMS NOT INCLUDED IN YOUR TOUR:
AIR TRANSPORTATION AND ALL RELATED TAXES AND FEES, passport fees, visa fees (ETIAS – may be needed for all U.S. citizens entering Schengen countries in the European Union. More information and application on this website https://www.etias.us/application/). Personal expenses such as laundry and communication charges; hotel mini-bars, room safe box, travel insurance; travel agency service fees, optional sightseeing excursions; excess baggage charges on aircraft; local departure air and other entry or departure taxes, airline fuel surcharges, airport facility taxes and federal inspection fees and meals not listed in the "Included Features" section. If you are arriving earlier, individually or later than the scheduled group, transfers; meals, lodging, and all alcoholic and non-alcoholic beverages are likewise not included, and all other services are not specifically mentioned in the "Included Features" section.
CHANGES:
Suppose the customer (or anyone in the customer’s party) decides to change any portion of confirmed arrangements on an individual or private group tour before departure. In that case, LU/CT&T will attempt to assist the customer at an administrative of $50 per change.
PASSPORTS, VISAS (ETIAS), INOCULATION CERTIFICATES:
TRAVEL DOCUMENTATION PROOF, SUCH AS PASSPORTS, VISAS (ETIAS), AND HEALTH-RELATED AND OTHER INOCULATION CERTIFICATES IF REQUIRED, REMAIN EACH TRAVELER’S SOLE RESPONSIBILITY. IT IS THE RESPONSIBILITY OF THE PASSENGER TO MAKE LU/CT&T AWARE WHEN THEY ARE TRAVELING ON A PASSPORT FROM A COUNTRY OTHER THAN THE USA. Non-U.S. citizens must consult with appropriate consulates to determine if any visas are needed and are solely responsible for obtaining all visas and entry documents. The passport expiration date should be at least 6 months following the return date of the tour. For further information, visit the USA State Department website www.travel.state.gov/travel, and the following sites www.tsa.gov, www.dot.gov, www.faa.gov.us, www.ustreas.gov, www.cbp.gov regularly for information regarding the incidence of disease, terrorism, safety issues, crime, the need for travel documentation such as passports, visas, proof of health/vaccination certificates, health hazards, and other restrictions regarding travel to your international destination(s), and re-entry into the United States. All citizens are required to have a valid passport to travel anywhere outside the United States. Visas and vaccinations may also be required for some destinations. Remember, each child traveling with you requires individual travel documentation as well. LU/CT&T recommends you have a minimum of three blank pages in your passport when traveling, as many countries require blank pages. You will need to check with your consulate to verify all requirements. (Caution: Please note that government rules regarding entry and departure change daily. If any damage or watermarks appear that will affect passport machine readers, replace them before the travel date, or you may not be allowed to travel.)
LIMITATION OF RESPONSIBILITY AND DISCLOSURE:
The customer understands and agrees that LU/CT&T is not the source or supplier of the travel services requested, and acts solely as a sales agent for disclosed principal supplier hotels, motor coach companies, ground transportation, and other independent contractors providing accommodations, transportation, and/or other services. Each of these companies is an independent entity with its own management, and is not subject to the control of LU/CT&T. Customer is advised that the suppliers whose names appear in travel documentation are those responsible for providing the travel services purchased, consent to the use of those suppliers, and understands and agrees each supplier’s Terms and Conditions are contained in printed form and/or on their respective websites. All bookings are accepted by LU/CT&T as sales agents for independent suppliers in the customer’s itinerary. Additionally, optional trip/tour excursions may become available for purchase. Travel activities carry with them the inherent risk of serious personal injury. The transportation, accommodations, and other services provided by the identified ground suppliers, and other travel provider services offered are subject to the terms and conditions contained in the tickets, exchange orders, or vouchers issued by them and/or their suppliers, including terms and conditions on their respective websites. Because LU/CT&T does not have the right to control the operations of independent suppliers, it is not liable for any personal injury or property damage, which may arise out of these services. LU/CT&T is not responsible for the willful or negligent acts and/or omissions of such suppliers or of any supplier or their respective employees, agents, servants, or representatives not under LU/CT&T’s control, including, without limitation, their failure to deliver or their partial or inadequate delivery of services or adhere to their schedules, or their cessation of services or bankruptcy, and/or failure to comply with any laws such as the Americans with Disabilities Act (“ADA”). The ADA is only applicable within the United States, and facilities for disabled individuals are limited outside its borders. A qualified and physically able companion must accompany travelers who need such assistance. The companion assumes total responsibility for the participant’s well-being. Transportation services, including all rental vehicles, and tour motor coaches, are not equipped with wheelchair ramps. Customer understands and agrees that LU/CT&T shall not be liable for any accident, injury (including death), property damage, or personal loss to the customer or to those traveling with the customer in connection with any accommodations, transportation, or other services or resulting directly or indirectly from any occurrences or conditions beyond its control, including, but not limited to, Acts of God, fire, volcanic eruptions, and resulting ash, wind, acts of governments or other authorities, wars, civil disturbances, riots strikes, epidemics, quarantines, acts of terrorism, defects in vehicles, breakdown in the equipment, strikes, theft, delay, wildlife, dangers incident to land and air travel, or cancellation of or change in itinerary or schedules. Weather conditions, including but not limited to the presence or absence of snow, sunshine, and rainfall, are not guaranteed to occur or not occur and are clearly outside the control of LU/CT&T.
LIMITATION OF LIABILITY:
Under no circumstances, including, but not limited to, error & omission, negligence, shall LU/CT&T be liable for any direct, indirect, special, or consequential damages arising out of or related to the use of, or the inability to use any LU/CT&T travel services, or any third party services, even if LU/CT&T has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall LU/CT&T’s total liability for all damages, losses, and causes of action, whether in contract, tort (including, but not limited to, negligence), or otherwise, exceed the commission and service fee amount received by LU/CT&T related to customer’s travel, if any.
LU/CT&T TOUR AVAILABILITY, PARTICIPATION, AND RIGHT TO ADJUST RATES AND ACCOMMODATIONS:
All LU/CT&T tours are based on a limited number of seats and reservations will be accepted on a first-come, first-served basis. LU/CT&T reserves the right to cancel any itinerary or any part of it, to make such alterations in the itinerary as it deems necessary or desirable, to refuse to accept or to retain as a member of any tour any person at any time, and to pass on to the customer any expenditure occasioned by delays or events beyond its control. All persons are also responsible for respecting the authority and following the tour guide's directions during a Tour. We may exclude you from participating in all or any part of the tour if, in our sole discretion, your condition or behavior renders you unfit for the tour or unfit for continuation once the tour has begun. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of tour services, or may constitute a hazard or embarrassment to himself/herself or others or otherwise impact the enjoyment of other passengers on the trip. LU/CT&T is not responsible for the behavior of other tour participants toward you or loss of enjoyment.
Prices quoted are based on costs and fares in effect at the time of printing and are subject to change before departure. LU/CT&T reserves the right to adjust its rates if there is any appreciable variation in its cost. The customer agrees that LU/CT&T will make every effort to honor the price as originally quoted, however; under certain circumstances, additional costs may be imposed for charges including the following: fuel surcharges, fluctuations in foreign exchange markets, or an increase in a government-imposed taxes or fees. All hotel accommodations mentioned in the LU/CT&T’s brochure are only an indication of accommodation(s), and the LU/CT&T reserves the right to substitute these accommodations at any time, with similar properties of the same or higher standard.
FORCE MAJEURE:
"Force Majeure" means, in relation to LU/CT&T, any circumstances beyond the reasonable control of LU/CT&T, (including, but without limited to, acts of God, explosion, flood, tempest, forceful wind, volcanic eruption, volcanic ash, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, insurrection, riots, strikes or other labor activities, civil disturbance, civil unrest, insurrection or revolt, animals, requisition, sickness, quarantine, food poisoning, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences). LU/CT&T shall not be deemed to be in breach of these terms and conditions or otherwise be liable to you, because of delay in performance, or by non-performance, of any of its obligations hereunder to the extent that any such delay or non-performance is due to any Force Majeure. Suppose LU/CT&T, and/or any of its travel suppliers, are affected by Force Majeure. In that case, they shall be entitled to, and may in their sole and absolute discretion, vary or cancel any itinerary or arrangement about the tour. Future tour credit or payment of any refund by LU/CT&T to you as a result of the non-performance of any obligations hereunder shall remain in LU/CT&T’s sole and absolute discretion. Furthermore, LU/CT&T shall be entitled to deduct from any credit/refund recoverable the reasonable actual and potential costs to LU/CT&T of the Force Majeure and applicable cancellation fees.
OTHER:
The client/s understands that LINCONNECTION USA / Czech Tours & Travel reserves the right to take photographic or film/video records of any of its programs, and agrees that LU/CT&T may use any such photographic or film records for any promotional and commercial purposes without any remuneration to the participant. Program members who prefer that their images not be used are asked to identify themselves to their travel program escort at the beginning of their program. The participant agrees to assign all rights, titles, and interests in or to any media in which their name or likeness might be used to LINCONNECTION USA/Czech Tours & Travel.
YOU SHOULD BE AWARE THAT EACH COUNTRY HAS PARTICULAR FEATURES THAT MAY NOT APPEAL TO YOU, INCLUDING WEATHER, FOOD, LOCAL CUSTOMS, ETC. THERE MAY BE DIFFERENT LIVING STANDARDS, PRACTICES, AND DIFFERENT STANDARDS AND CONDITIONS CONCERNING THE PROVISION OF UTILITIES, SERVICES, AND ACCOMMODATION IN THE COUNTRIES VISITED. SUCH STANDARDS MAY OR MAY NOT BE COMPARABLE TO THOSE YOU WOULD EXPECT FROM SIMILAR ESTABLISHMENTS IN THE UNITED STATES. BY PURCHASING THE TOUR, WE ASSUME THAT YOU HAVE MADE ALL REASONABLE INQUIRIES ABOUT THE TRAVEL SERVICE.
This agreement shall be governed by and construed by the laws of the State of Nebraska, without giving effect to any principles of conflicts of law. If any provision of this agreement shall be unlawful, void, or for any reason is unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein and shall not be modified except in writing, signed by both parties. The customer agrees to submit all claims against LU/CT&T within 30 days after the Customer’s return.
Any claims will be resolved by binding arbitration, rather than in court, except you may assert claims on an individual basis in small-claims court if they qualify. This includes any claims you assert against us, our subsidiaries, travel suppliers, or any companies offering products or services through us (which are beneficiaries of this arbitration agreement).
